By submitting a design to Aviva Design, you warrant and represent that you are the sole, legal owner or licensee of all rights, including copyright, to each copyright, trademark, service mark, trade name, logo, statement, portrait, graphic, artwork, photograph, picture or illustrations of any person or any other intellectual property included in such design.

By submitting a design, you warrant and represent that no part of the design violates or infringes upon any common law or statutory right of any person or entity; is the subject of any notice of such infringement you have received, or is subject to any restriction or right of any kind or nature whatsoever which would prevent Aviva Design from legally reproducing the images or text submitted.

You agree to defend, at your sole expense, any claim, suit, or proceeding brought against Aviva Design which relates to, or is based upon a claim that any portion of the design infringes or constitutes wrongful use of any copyright, trademark, or other right of any third party, provided that Aviva Design gives you written notice of any such claim and provides you such reasonable cooperation and assistance as you may require in the defense thereof. You shall pay any damages and costs assessed against Aviva Design pursuant to such a suit or proceeding.

In case of logo design order Aviva Design keeps its design rights. From the moment you receive the desired product any further you are the sole party obtaining right over it.

All items on this website containing corporate logos or registered trademarks are shown only to illustrate Aviva Design logo reproduction or logo design capabilities.

The trademarks, logos, and service marks displayed on this web site are the property of Aviva Design or other third parties. Users are not permitted to use these Marks without the prior written consent of Aviva Design or such third party that owns a particular Mark. Terms of Sale and Shipping

Payment for orders shall be by credit card or a check. Credit cards information shall not be transmitted via e-mail. If done so, Aviva Design shall not be held responsible in case of infringement of privacy resulting from this method of information transfer. Orders are not binding on Aviva Design until accepted by Aviva Design. It is possible that products displayed on this website are out-of-stock or discontinued.

Currently, sales tax in added to all orders shipping within California .

Title to products passes from Aviva Design to you upon shipment from our facility. This means that you own the merchandise from that point on. We cannot be held responsible for goods list or delayed by common carrier, international or US Customs departments or by ‘acts of God'. Loss or damage occurring during shipment is customers' responsibility.

Once and order has been specified and confirmed, we cannot guaranteed our ability to make changes or cancellations to an order. Aviva Design will make every effort to comply with your cancellation request. If the order has already been specified, there could be a minimum restocking charge imposed.

Jurisdiction

This web site and its terms and conditions will be governed and be interpreted pursuant to the laws of the State of California , United States of America , notwithstanding any principles of conflicts of law. If any part of these terms and conditions is unlawful, void or unenforceable, that part only will be deemed severable and will not affect the validity and enforceability of any remaining provision.
